O Brasil tem 654.372 presos, sendo 221 mil deles provisórios, que ainda não foram julgados. Os dados são do Conselho Nacional de Justiça (CNJ) e foram obtidos após a presidente do conselho, ministra Cármen Lúcia, ter determinado aos tribunais de todo o país que atualizassem dados sobre o sistema carcerário brasileiro.

O levantamento mostra que o crime de tráfico de drogas representa 29% dos processos que envolvem réus presos, seguido por roubo (26%), homicídio (13%), porte ilegal de arma (8) e furto (7%) e receptação (4%).

Segundo a pesquisa, o tempo de encarceramento provisório nos estados varia entre 172 e 974 dias, e os presos provisórios representam de 15% a 82% da massa carcerária dos estados.

Em janeiro, após a explosão da crise de superlotação nos presídios do Amazonas e do Rio Grande do Norte, Cármen Lúcia pediu que os tribunais de Justiça adotassem medidas para acelerar o julgamento de presos provisórios . Os dados do CNJ foram obtidos a partir de informações enviadas por 25 tribunais do país. Segundo o conselho, os tribunais de Mato Grosso do Sul e Tocantins não enviaram as informações solicitadas.
