Nesta semana, em Portugal, uma polêmica decisão da Justiça ganhou as manchetes dos jornais. Para fundamentar acórdão de caso de violência doméstica praticada contra uma mulher, na cidade do Porto, o juiz minimizou a sentença do agressor pelo fato de ela ter cometido adultério.
O assunto teve muita repercussão e mais de sete mil pessoas já haviam assinado, até o final da manhã desta quarta (25), uma petição pedindo ao Conselho Superior de Magistratura (CSM) e ao Provedor de Justiça que se manifestem sobre o caso. O autor da sentença é Joaquim Neto de Moura, desembargador do Tribunal da Relação do Porto.
O texto da petição afirma que “a desigualdade e a subalternização das mulheres é uma realidade quotidiana da sociedade portuguesa. Mas não contávamos vê-la, assim, expressa de uma forma tão óbvia e tão indigna por parte de um órgão de soberania. Indigna para mulheres, indigna para homens”.
O acórdão assinado pelo juiz no dia 11 de outubro, afirma que a conduta dos agressores ocorreu em um contexto de adultério praticado por uma mulher e traz uma citação da Bíblia para justificar a violência cometida.
“Ora, o adultério da mulher é um gravíssimo atentado à honra e dignidade do homem. Sociedades existem em que a mulher adúltera é alvo de lapidação até à morte. Na Bíblia, podemos ler que a mulher adúltera deve ser punida com a morte”, afirmou o juiz, na polêmica sentença.
O acórdão diz ainda que o adultério é uma conduta que a “sociedade sempre condenou e condena fortemente (e são as mulheres honestas as primeiras a estigmatizar as adúlteras) e por isso vê com alguma compreensão a violência exercida pelo homem traído, vexado e humilhado pela mulher. Foi a deslealdade e a imoralidade sexual da assistente que fez o arguido “X” cair em profunda depressão e foi nesse estado depressivo e toldado pela revolta que praticou o ato de agressão”.
Repúdio
Após a ampla divulgação da sentença, a sociedade civil e entidades de defesa dos direitos humanos mostraram preocupação com a legitimação e o incentivo de comportamentos violentos contra mulheres, usando como justificativas possíveis adultérios.
Entidades como a Associação Portuguesa de Mulheres Juristas, a Associação Portuguesa de Apoio à Vítima e o próprio Conselho Superior de Magistratura vieram a público alertar sobre a necessidade de se respeitar os valores expressos na Constituição portuguesa.
O CSM, em nota, afirmou que a “obediência dos juízes à Constituição e à lei determina, necessariamente, que as sentenças dos tribunais devem espelhar essa fonte de legitimidade, realizando a justiça do caso concreto sem obediência ou expressão de posições ideológicas e filosóficas claramente contrastantes com o sentimento jurídico da sociedade em cada momento, expresso, em primeira linha, na Constituição e Leis da República, aqui se incluindo, tipicamente, os princípios da igualdade de gênero e da laicidade do Estado”.
A Amnistia Internacional Portugal, entidade de defesa dos direitos humanos, expressou, em nota divulgada no site, a preocupação “não só pela atuação dos juízes desembargadores ao arrepio dos preceitos legais e constitucionais, mas pelo espelhar de uma cultura e justiça promotora de misoginia, sem ter em conta os direitos das mulheres, e como recurso à compreensão da violência para vingar a honra e a ‘dignidade do homem’”.
O texto ressalta ainda que Portugal está vinculado não só aos tratados internacionais de direitos humanos dos quais é parte, mas também às obrigações previstas na Convenção do Conselho da Europa para a Prevenção e o Combate à Violência Contra as Mulheres e a Violência Doméstica, conhecida como Convenção de Istambul.
O caso
No caso em questão, dois homens (o marido e um amante, com quem a mulher teria tido uma relação durante dois meses) tiveram as penas de prisão suspensas pelos crimes de violência doméstica, detenção de arma proibida, perturbação da vida privada, injúrias, ofensa à integridade física e sequestro. De acordo com o processo judicial, após a mulher terminar as duas relações, os homens a ameaçaram, ofenderam, perseguiram, e a espancaram com um pedaço de madeira com pregos nas pontas. O documento traz a descrição de diversos ferimentos por todo o corpo, inclusive com corte no rosto que teve de ser suturado.
Histórico
Joaquim Neto de Moura, em um acórdão de junho de 2016, já havia escrito que “uma mulher que comete adultério é uma pessoa falsa, hipócrita, desonesta, desleal, fútil, imoral. Enfim, carece de probidade moral”. E concluiu que “não surpreende que recorra ao embuste, à farsa, à mentira para esconder a sua deslealdade e isso pode passar pela imputação ao marido ou ao companheiro de maus tratos”.
